English with Nique - Terms of use

 

Important Definitions and Overview of the Service

English with Nique (hereinafter referred to as the 'sites'), the services provided (hereinafter referred to as the 'services'), and any or all software downloads available from English with Nique are bound by the terms found herein. By using the sites or the services, downloading or installing the software, or otherwise accessing the sites, services, or downloads, you agree to the terms and conditions set forth below (‘terms’). If you do not agree with these terms and conditions, you may not access, install, download or otherwise use the sites, the services, or the software. If someone else (guardians, parents, etc.) is paying for your tutoring services, they are also bound by these terms of use, and you are required to print this page and give it to them. We reserve the right to make changes to these terms at any time, either with or without your knowledge. Any modifications become effective as soon as they are posted to the sites, and you should periodically review the terms for any changes. Continuing to use the sites after such modifications have been posted, will constitute your agreement to and acceptance of the modifications.

 

User Agreement

I. Student’s Warranties

Each of the Students hereby warrants to us and to all Users the following:

 

a. He or she will not provide any other User of the Sites with any information that could allow him to be personally identified including, but not limited to, phone number, email address, home address, postal address, website address or details of any organization, school or body of which the User is a member.

 

b. His or her behaviour will not be disruptive, offensive, abusive, unlawful, harassing, defamatory, threatening, harmful, obscene, profane, sexually-oriented, racially offensive or otherwise objectionable in any respect.

 

c. He or she is not less than thirteen years old. Students of younger age can only participate with the consent from and involvement of a parent or guardian.

 

d. Students are required to pay for an online session in advance.

 

e. Payments can only be made through the PayPal system, wire transfer, or bank deposit (Trinidad & Tobago only).

Users agree to use the Zoom cloud meetings service at Zoom.us in accordance with the following rules (“the Rules”):

No disruptive, offensive or abusive behaviour: contributions must be constructive and polite, not mean-spirited or contributed with the intention of causing trouble.

No unlawful or objectionable conduct: unlawful, harassing, defamatory, abusive, threatening, harmful, obscene, profane, sexually-oriented, racially offensive or otherwise objectionable material is acceptable.

No spamming or off-topic material: discussions should be relevant to the topic at hand and must not include unsolicited promotional material.

No advertising or promoting: we will not tolerate advertising, promoting or posting other website addresses on our Sites.

No impersonation.

No inappropriate (e.g. vulgar, offensive etc.) user names.

 

f. Users may not use the cloud meetings service facility to submit or share any defamatory or illegal material of any nature. This includes text, graphics, video, programs or audio. Submitting or sharing material with the intention of committing or promoting an illegal act is strictly prohibited. Users agree to submit or share only contributions, which are their own original work. Users must not violate, plagiarize, or infringe the rights of third parties including copyright, trademark, trade secrets, privacy, publicity, personal or proprietary rights.

 

g. If a User fails to abide by the Rules (and any variations thereto), he or she will be sent an email, which informs him or her why they have breached the Rules. This email will also include a warning that his continuing to break the Rules may result in action being taken against them. This action may include the temporary or permanent suspension of such user's ability to participate in any Online Sessions. If we consider such breach of the Rules to be serious and/or repeated, we may use whatever information that is available to us about the User to stop any further breaches. This may include informing relevant third parties such as the police or email provider about the infringement. We reserve the right to take action against any User or any account, at any time, for any reason. We reserve the right to terminate a registration if a User disrupts any of our services in any way.

 

h. Users are responsible for ensuring that their computer systems meet all relevant technical specifications necessary to use the Sites and that they are compatible with the Sites. Users also understand that we cannot and do not guarantee or warrant that any material available for downloading from the Sites will be free from infection, viruses and/or other code that has contaminating or destructive properties. Users are responsible for implementing sufficient procedures and virus checks (including anti-virus and other security checks) to satisfy their particular requirements for the accuracy of data input and output.

 

i. We accept no responsibility for any consequence relating directly or indirectly to any action or inaction you take based on the information, services or other material available on or through these Sites.
